1. Overview
The following regulations govern all interactions between DS BodyShop Ltd and our clients. By utilizing our expertise, you acknowledge your agreement.
2. Repair Authorization
By confirming a repair order either via digital signature or verbal agreement, you permit DS BodyShop Ltd to execute the specified works. This grant includes authorization for our qualified staff to drive the vehicle on public roads for testing purposes.
3. Pricing Estimates
- Quotes are valid for a 30-day window. We maintain the right to adjust costs if hidden defects appear during dismantling. No job exceeding the initial quote by 10% or more will proceed without your explicit consent to the updated pricing structure.
4. Collection of Vehicles
DS BodyShop Ltd does not offer a shipping or delivery service. All vehicles must be collected from our premises at Block 2, Unit 3, Clamp Road, Wishaw, North Lanarkshire, once repair work is complete. Customers will be notified when their vehicle is ready for collection.
5. Warranty and Aftercare
Our workmanship warranty covers defects arising from the repair itself. It does not cover damage caused by failure to follow our aftercare guide, or by external factors occurring after collection, including but not limited to accidents, road debris, contamination, or improper cleaning or storage. Customers are provided with an aftercare guide at the point of collection and are responsible for following it to maintain warranty cover. This clause does not affect your statutory rights under the Consumer Rights Act 2015.
6. CCTV
CCTV operates on these premises for the safety and security of our staff, customers, and property. This processing is carried out under our legitimate interests as data controller, in accordance with UK GDPR and the Data Protection Act 2018. DS BodyShop Ltd is registered with the Information Commissioner's Office (ICO). Recordings are retained for 30 days and access is restricted to authorised staff only. 7. Governing Law and Jurisdiction
These terms, and any dispute or claim arising out of or in connection with them or our services, shall be governed by and construed in accordance with the law of Scotland, and the parties submit to the exclusive jurisdiction of the Scottish courts. Where a customer is a consumer resident outside Scotland, nothing in this clause removes any mandatory consumer protections you are entitled to under the law of your country of residence.
8. Billing
Full payment is required once repairs are finished and prior to car pickup. Our facility accepts cash, BACS, chip and pin card payments, or cleared insurance company settlements.
9. Right of Lien & Storage
DS BodyShop Ltd maintains a specific and general lien over the vehicle, granting us the legal right to retain possession until all labor and parts invoices are paid in full. Although the customer remains the legal owner, the vehicle will not be released if payments are incomplete. If the vehicle is stay-over for more than 48 hours after notification of completion, daily storage fees of £35 + VAT will accrue. Should the balance remain unpaid for over 30 days without prior written agreement, we reserve the legal right to sell the vehicle to recover all outstanding costs, parts, and storage overheads.
10. Damage Assessment Reports
An inspection occurs when the vehicle arrives. DS BodyShop Ltd is not liable for existing scratches or mechanical faults documented at drop-off or for issues entirely unrelated to the specific paint and bodywork commissioned.
11. Liability
While we operate under comprehensive motor trade insurance, we specifically request that all personal valuables be removed. DS BodyShop Ltd holds no responsibility for the loss of internal goods left in the car during the repair cycle.
Client Agreement: By instructing DS BodyShop Ltd to begin work or by signing a job card, you verify that you have understood and accepted these comprehensive terms of business.
